1. Introduction

Welcome to Little Legend. This website, www.littlelegend.com.au (the "Site"), is operated by B Brand Marketing Pty Ltd (ABN 76 646 842 266) ("Little Legend", "we", "us" or "our"), based in Queensland, Australia.

By visiting the Site or buying from us, you agree to these Terms of Service ("Terms"), together with our Refund & Exchange Policy and Privacy Policy. Please read them carefully. If you don't agree, please don't use the Site.

We may update these Terms from time to time. The version on the Site at the time you place your order applies to that order.

2. Using our Site

You agree to use the Site only for lawful purposes. You must not:

  • Use the Site in any way that breaches any law or regulation
  • Attempt to gain unauthorised access to the Site, our systems or other users' accounts
  • Introduce viruses or other harmful code, or interfere with the Site's operation
  • Copy, scrape or reproduce Site content for commercial use without our written permission
  • Use the Site to send spam or unsolicited promotional material

If you are under 18, please use the Site with the involvement of a parent or guardian. Our products are designed for children, but purchases must be made by an adult.

3. Products and descriptions

We take care to describe and photograph our products accurately. However, colours may vary slightly depending on your screen, and we don't guarantee that product descriptions, images or other content are completely error-free. Sizing guides are provided as a guide only.

We may change, discontinue or limit the availability of any product at any time.

4. Pricing and payment

  • All prices are in Australian dollars (AUD) and include GST, unless stated otherwise.
  • Prices and promotions can change without notice. The price at the time you place your order is the price you pay.
  • We accept the payment methods shown at checkout. Payments are processed securely through our payment providers, and we don't store your full card details.
  • If we discover a pricing or product error after you've placed an order, we may cancel the order and refund you in full, or contact you to confirm whether you'd like to proceed at the correct price.

5. Orders and acceptance

Placing an order is an offer to buy. We accept your order when we send you a dispatch confirmation, or when we otherwise confirm it in writing. We may decline or cancel an order for reasons including stock availability, pricing errors, suspected fraud or problems with payment. If we cancel an order after payment, we'll refund you.

6. Pre-orders

Some products are offered for pre-order. Pre-order items are made available on the estimated timeframe shown on the Site, which is an estimate only and may change. We'll contact you if there is a significant delay. The exchange and credit note period for pre-order items starts from the date you receive your order, as set out in our Refund & Exchange Policy.

7. Shipping and delivery

  • We ship within Australia, and shipping costs and options are shown at checkout. 
  • We offer free shipping on orders over $100 (AUD), as shown on the Site. This offer may change or end at any time.
  • Delivery timeframes are estimates only and are not guaranteed. We aren't responsible for delays caused by carriers, weather, public holidays or other events outside our control.
  • Please make sure your delivery address is correct. We aren't responsible for orders delivered to an incorrect address provided by you.
  • Risk in the goods passes to you on delivery. If your order doesn't arrive, please contact us promptly so we can investigate with the carrier.

8. Refunds, exchanges and returns

Our Refund & Exchange Policy forms part of these Terms. In summary, we don't offer refunds for change of mind, but we do offer an exchange or credit note within 14 days of receiving your order, subject to the conditions in that policy. Return shipping costs for change-of-mind returns are the buyer's responsibility.

9. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

10. Product care and safe use

Please follow the care instructions provided with our products. Children should always be supervised, and you should check items for damage or wear before use. Items are not designed to replace sun protection. Please use appropriate sun protection for children, such as sunscreen, shade and sun-protective clothing.

11. Intellectual property

All content on the Site, including the Little Legend name, logo, designs, graphics, photographs, text and product artwork, is owned by or licensed to us and is protected by copyright, trade mark and other intellectual property laws. You may not copy, reproduce, modify or distribute any content without our written permission, except for your own personal, non-commercial use.

12. User content and communications

If you send us content, such as reviews, comments, photos or social media tags, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with our business and marketing, unless you tell us otherwise. You confirm that you own or have the right to share it, and that it is lawful and not offensive or misleading.

If you subscribe to our mailing list or the Little Legends Club, we'll send you updates and offers. You can unsubscribe at any time using the link in our emails.

13. Privacy

We collect and use your personal information in accordance with our Privacy Policy.

The Site may include links to third-party websites or use third-party services (such as our e-commerce platform and payment providers). We don't control and aren't responsible for those sites or services, or for their content or policies.

15. Limitation of liability

To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law:

  • We provide the Site and its content "as is" and don't guarantee it will be uninterrupted or error-free
  • We aren't liable for any indirect or consequential loss arising from your use of the Site or our products
  • Where we are liable and the law allows us to limit our liability, our liability is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so

Nothing in these Terms limits liability that cannot be limited by law.

16. Force majeure

We aren't liable for any failure or delay in meeting our obligations caused by events beyond our reasonable control, including natural disasters, strikes, supply chain disruptions, carrier delays, pandemics or technical failures.

17. Governing law

These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.

18. Changes to these Terms

We may update these Terms at any time by posting the revised version on the Site. Your continued use of the Site after changes are posted means you accept them.
